Immigration/ Departure Help

Hello,
My family & I have been in D.R for about a year now. We paid an attorney to start the residency process but have now found out that he has done nothing.
We have a family emergency and must return to the US in May.
It has come to our knowledge that since our immigration process was never started, we are currently in the "overstay" status and will have to pay to leave the country. Also, when we first arrived (May 2012), we were under the impression that we had a 90 day tourist card stay (please comment if this was ever true). Now, because of the nature of our return, immigration stuff not being started, that fact that our overstay may be over 11 months, and our funds being stretched, we are not prepared to pay 10,000 pesos as the penalty fee before we can leave. I was wondering if anyone here is and immigration officer or knows any immigration officer that can help. Any advice or thought on the most economical way of leaving the D.R. would be highly appreciated. Thanks & Have a Great Day!
