IDENTIFICACION RESIDENCIA FISCAL

We often discuss on this fórum - whether, or not, your financial data relating to assets/activities outside Colombia can be reported to DIAN. Here are the opening paragraphes of a letter I have just received from Banco Santander, one of the Banks I retain outside of Colombia. This is not new, it is pretty much a simple paste and copy every year.

Estimado cliente,

Como seguramente conoce, las entidades financieras estamos obligadas por requerimiento legal a identificar todos los países donde nuestros clientes pueden tener obligaciones fiscales y reportarios a la Administración Tributaria Española (AEAT), quien transfería dicha información al Estado que corresponda Actualmente, por los datos disponibles consideramos que usted podría tener obligaciones fiscales por motive de residencia o ciudadanía en COLMBIA.

Como me afecta este requerimiento?

Le informamos de que en base a los datos que usted nos ha proporcionado, Banco Santander , S.A., comunicara a la AEAT la siguiente información del ejercicio 2022 relativa a su persona:

N° de identificación fiscal del país de tributación
Nombre y apellidos
Fecha de nacimiento
Lugar de nacimiento (ciudad y Estado)
Dirección habitual
País de residencia fiscal
N° de cuenta financiera y saldo o valor total
Importes pagados o anotados en relación de la cuenta.

If this merits further discussion within the forum I will admit upfront this only really concerns those expats in Colombia who have chosen, or accepted to fly WITHIN the range of Colombian radar. I bought a property in Colombia and opened a bank account in my name in Colombia. So, to those waiting the opportunity to say “that is your fault”, they are correct.
