Non-quota immigration visa

I am planning to marry a Filipino citizen in January and I want to apply for the visa. I noticed they do a BI investigation and I have 2 misdemeanors, DUI and harassment in the USA. Would that disqualify me? I know I can go the route of extending the 30 day for a long time until I have to return and come back, but I would rather go this visa route if I can. Thanks for all the help.
