13A NBI

I am married to a Filipina and want to apply for a 13A visa. However I have a small problem that concerns me. I have been living in the Philippines for over 5 years now. 3 years ago I have to return to USA on business and while I was there I got into a family dispute, I was arrested for domestic violence. I posted bail, the court hearing date was later than my flight back to Philippines so I returned to Philippines (flight was already booked). I believe I have an outstanding warrant for failing to appear in court. It's a simple domestic, no charges were filled by the other party, but the state picks up these type of cases. My question is. 1. Will this be a problem with getting a 13A visa.
2. If they find this warrant will they make me leave the Philippines, I am married and living with my Philippine wife.
