Legal question about EEA2 residence card

Hello! I am a US citizen currently living in London, married for nearly 4 years to a Greek citizen (who also lives here). When I arrived in London in Jan. 2008, I had the 6 month EEA1 family permit, which has now expired. I applied for my EEA2 residence card in May 2008 and received my Certificate of Application at the beginning of June 2008. Since then, there has been no movement on my visa. I've called the Home Office numerous times, only to hear that my application is being considered. That part of the story should sound familiar. I've also been detained once when re-entering the UK after a visit to the US, and received a 6 month entry stamp in my passport as a result. More recently, I've returned from abroad and received a new 2 month stamp (the remaining 2 months of the original 6 month stamp) that states: "No work or recourse to public funds." Here is my question, I understand that the UK is in violation of EU law by not issuing a visa to a spouse of an EU citizen within 6 months, BUT is the stamp that I received a further violation? It was my understanding that as long as my spouse was an EU citizen and we had a marriage certificate and I was waiting on my EEA2 with a COA, I could still work. Any thoughts?
