I was reminded of the importance of really checking out people before you decide to work with them in Ecuador! Ecuador, like most places in Latin America, can seem like the wild west of real estate investing sometimes.

You can’t just go with your gut and work with someone because they seem helpful. You must due diligence and use your own discretion making sure people really EARN your trust before working with them… and treat the folks I mentioned last week the same way you would anyone else.

There are a lot of genuinely good people in Ecuador, but like anywhere, there are a few misguided apples that try to hide in the woodwork (disorganization).

So how can we check out an individual or a business in Ecuador and discover some shady dealings they may have been involved with in the past?

The first, most obvious way you can check out someone is to ask for references of past clients and actually contact those references (preferably visiting in person) asking probing questions.

But another great way few people know about is to run a background check.

Yes… Ecuador is a third world country, but Ecuador does keep impressively accurate and up-dated public records and with each passing year more and more of this info is becoming openly published on the internet for anyone to see!

So, to see if someone in Ecuador has had legal issues or lawsuits filed against them in the past or present, and to see the details regarding those lawsuits or issues…know the following:

First, know that in the capital of each Ecuadorian province “provincia” there is an office called the “Funcion Judicial”. In this office, lawsuits and court cases of the province are recorded. Most local taxi drivers will know where it is.

So, for example, before choosing to work with or invest with an individual in Ecuador, make a copy of their “cedula” (which is their ID card in Ecuador). Everyone with legal residency in Ecuador has one.

Then, take that copy to the office of the “Funcion Judicial” in the province where they reside or do business to inquire about their legal record and see if they have had any lawsuits hung on them in the past and for what.

…with simply their full name; first, middle, last, and second last name as it is appears on their “cedula” (everyone in Ecuador except foreigners have two last names)… you can go to the website of the “Funcion Judicial” of the province in question and search their name (last names first, first names last) to see if they have a legal history… with instant results… and if they do have a legal history, you can click on the cases against them and read about them!
Remember, if they do or have done business across multiple provinces be sure to check the various corresponding offices.

Once on the websites look for the link “Consulta de causas” then once on the search form just fill in the blank “Diputados” (Defendant) with the full name of the person you want to check out (last names first, first names last) and click search…if they have, or have had legal records in that province they will appear!
